General Terms
1. Agreement
These General Terms govern your use of elatosa.digital and services offered by Elatosa Digital, located in Goyang-si, Gyeonggi-do, Republic of Korea. By accessing the site or engaging our consultancy, you agree to these terms.
2. Services Description
Elatosa Digital provides subscription lifecycle consultancy, including automated email journey design, segmentation, template systems, and testing plans. Deliverables are described in statements of work. Informational prices on this site are not binding offers.
3. Client Responsibilities
Clients must provide accurate data, timely feedback, and lawful contact lists with documented consent. You are responsible for final approval of sends and for compliance with applicable marketing laws in your jurisdictions.
4. Intellectual Property
Unless otherwise stated in a statement of work, deliverables created specifically for you are licensed for your internal use upon full payment. Elatosa Digital retains rights to pre-existing methodologies, frameworks, and non-client-specific templates.
5. Confidentiality
Both parties will protect confidential information shared during engagements. Confidentiality obligations survive termination for three years, except where disclosure is required by law.
6. Limitation of Liability
To the fullest extent permitted under Republic of Korea law, Elatosa Digital is not liable for indirect, incidental, or consequential damages. Aggregate liability for any claim is limited to fees paid for the specific engagement giving rise to the claim during the prior twelve months.
7. Governing Law and Disputes
These terms are governed by the laws of the Republic of Korea. Parties agree to the exclusive jurisdiction of courts in Gyeonggi-do, Korea, after good-faith negotiation for thirty days.
8. Termination and Modifications
Either party may terminate an engagement per the statement of work. We may update these General Terms by posting a revised version with a new last-updated date. Continued use after changes constitutes acceptance.
